(2) THE APPLICANT:
(I) SHALL SUBMIT AN APPLICATION FOR
REEXAMINATION TO THE STATE BOARD ON THE FORM THAT THE STATE BOARD
PROVIDES; AND
(II) UNLESS, FOR GOOD CAUSE, THE STATE BOARD
WAIVES PAYMENT OF THE APPLICATION FEE, SHALL AGAIN PAY THE
APPLICATION FEE UNDER § 2-305 OF THIS SUBTITLE.
COMMITTEE COMMENT: Subsection (a) of this section is added
as standard language.
Subsections (b) through (i) of this section are new
language derived from former Art. 56, §§ 533(e) and
534(e), the first and third through sixth sentences of
(c), and the third and fifth through seventh sentences
of (d).
In subsection (b) of this section, the word "dates" is
added to facilitate the implementation of the
requirement that an individual submit an application
45 days before the examination date.
Also in subsection (b) of this section, the former
phrase "within the State" is deleted.
In subsection (d)(2)(i) of this section, the former
reference to "rules" is deleted in light of the
reference to "laws".
In subsection (h) of this section, the limitation "who
failed an examination" is added for clarity.
In subsection (i)(2)(i) of this section, the reference
to an "application for reexamination" is substituted
for the former reference to a "new application" to
clarify that the application for reexamination is not
the same as the initial application for examination.
The State Board sends an applicant for reexamination a
card to be returned with the applicant's name and
address on it. Unless a qualification has changed
between the time the applicant first applied for an
examination and the time that the applicant applies
for a reexamination, no new application is required.
In subsection (i)(2)(ii) of this section, the
reference to waiver of the "application fee" is
substituted for the former reference to waiver of
"{t}his requirement", for clarity and conformity to
the current practice of the State Board.
