unlike subsection (a)(2) of this section, subsection
(a)(1) only restricts installation.

Subsections (a)(2) through (c) of this section is new
language derived from former Art. 56, § 445(b) and
(d).

The former law, in former Art. 56, § 445(b)(1),
specifically prohibited the sale or installation only
of fixtures or other devices that did not limit water
consumption, to rates set out with specificity in
former § 445(a). This restriction is carried forward
in subsection (a)(2) of this section. The Joint
Subcommittee on Business Occupations was apprised that
the current State Plumbing Code incorporates these
limits and, therefore, felt that the limits need not
be retained in the statutes. Section 15 of this Act
ensures, however, that the State Plumbing Code
standards never fall below the former statutory
limits. Thus, subsection (a)(2) of this section, when
read with Section 15 of this Act, is intended to
preserve the minimum restrictions on sale and
installation in former Art. 56, § 445. Accordingly,
former Art. 56, § 445(a)(1) through (5) is deleted.

In adding § 3-205(c) of this title, consideration was
given to the provisions for enforcement of the
requirements of the State Plumbing Code. Accordingly,
former Art. 56, § 455(d)(1) and (2), which originally
was proposed for deletion, was reinstated by amendment
as subsection (c)(1) and (2) of this section and as §
3-606(b)(l) and (2).

Former Art. 56, § 445(a)(6), which defined the word
"[b]uilding" in terms of initial construction begun
after January 1, 1979, is deleted as obsolete.

Former Art. 56, § 445(a)(8), which defined the term
"[l]ocal plumbing inspectors" as county and municipal
inspectors for plumbing fixtures and devices and
water, drainage, and sewage systems, is deleted as
surplusage.

Former Art. 56, § 445(a)(10), which defined the term
"Secretary", is deleted as unnecessary in light of the
definition § 1-101 of this article.
