that former reference was intended only to encompass
the comparable federal injunctions. Under federal
law, an order that is granted, without a hearing, to
enjoin action is denominated a "temporary restraining
order". However, in common usage, a "temporary
injunction" would encompass both the Maryland forms of
"ex parte" and "interlocutory" injunction.

Also in subsection (c)(1) of this section, the defined
term "person" is substituted for the former limited
reference to "any citizen of this State", for clarity.

Also in subsection (c)(1) of this section, the former
reference to conduct as "continuing" is deleted as
unnecessary in light of the reference to
"irreparable".

In subsection (c)(2)(i) of this section, the former
specific reference to an "association, copartnership,
or corporation" is deleted as included in the defined
term "person".

3-209. DISPOSITION OF MONEY.

THE BOARD SHALL PAY ALL MONEY COLLECTED UNDER THIS TITLE
INTO THE GENERAL FUND OF THE STATE.

COMMITTEE COMMENT: This section is new language derived
from former Art. 56, § 451.

The phrase "under this title" is substituted for the
former limited phrase "under the provisions of § 450",
which referred only to fees for the issuance and
renewal of certain licenses, since, in fact, the Board
collects other fees and these fees also are paid into
the General Fund.

3-210. AUTHORITY OF SECRETARY.

THE BOARD EXERCISES ITS POWERS, DUTIES, AND FUNCTIONS
SUBJECT TO THE AUTHORITY OF THE SECRETARY.
