oath within the required time period a refusal and
required the Governor to fill a vacancy caused by a
refusal "as provided in § 449. of this article", are
deleted as unnecessary in light of subsection fa) of
this section and as misleading in light of the power
of the Governor to make interim appointments when the
General Assembly is not in session.
The second sentence of former Art. 56, § 452, which
abolished the State Board of Commissioners of
Practical Plumbing established in 1886 to regulate the
plumbing profession in Baltimore City, transferred its
books, papers, and money to the present Board
appointed in 1910, and provided for the continuation
of the effect of the acts of the Board established in
1886, is deleted as obsolete.
Subsection (e)(4) of this section is a standard
provision that appears in the "Membership" section of
almost all revised titles that relate to boards. The
provision applies:
(1) when a successor is appointed to replace a
member who has died, been removed, or failed for any
other reason to complete a term;
(2) when a member is appointed to succeed a
member who has "held over" to part of the next term,
pending the delayed appointment and qualification of
the successor; or
(3) when, in any other situation, a member
takes office after a term has begun, e.g., at the
completion of a term there is a delay in the
appointment of a successor, but the member who served
the prior term does not "hold over", thus creating, at
the start of the next term, a vacancy that is
associated neither with the replacement of a member
who served part of the current term nor with the
completion of a term started by a "holdover".
