SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988, contingent on an appropriation of funds
for fiscal year 1989 for respite care for individuals who are
functionally disabled and who, prior to enactment of this Act,
are ineligible for respite care, and if adequate funds for
respite care for these functionally disabled individuals are not
appropriated for fiscal year 1989, this Act shall be null and
void without the necessity of further action by the General
Assembly.

AN ACT concerning
Natural Resources Offenses - Failure to Appear -
Prepayable Fines
FOR the purpose of clarifying the authority of the Chief Judge of
the District Court of Maryland to adopt a schedule of
prepayable fines for the first offense misdemeanor
violations of the Natural Resources Article; requiring
certain notice to persons who fail to appear in court
pursuant to a citation for violating certain sections of the
Natural Resources Article; establishing a certain prepayable
fine for failure to appear; authorizing the issuance of a
warrant in certain circumstances; clarifying the legal
effect of prepaying a fine; repealing the penalty of
incarceration for certain first offense misdemeanor
violations of the Natural Resources Article; limiting the
prepayable fine to a certain amount; providing that
defendants charged with certain misdemeanors may pay fines
in lieu of appearing for trial; and generally relating to
the adoption of a fine schedule for Natural Resources
offenses.
