ANY PERSON WHO INTENTIONALLY ACTIVATES AN ALARM SIGNAL OR
OTHERWISE SUMMONS LAW ENFORCEMENT AGENCIES FOR A NONEMERGENCY
SITUATION IS GUILTY OF A MISDEMEANOR AND UPON CONVICTION IS
PUNISHABLE BY:
(1) A FINE OF NOT MORE THAN $500; OR
(2) IMPRISONMENT FOR NOT MORE THAN 90 DAYS; OR
(3) BOTH IMPRISONMENT AND A FINE. SUBJECT TO A FINE
NOT EXCEEDING $500 OR IMPRISONMENT NOT EXCEEDING 90 DAYS OF BOTH.

(A) EXCEPT FOR ALARM SYSTEMS ACTIVATED BY ACTS OF GOD,
WEATHER CONDITIONS, AND OR CAUSES BEYOND THE CONTROL OF THE ALARM
USER, THE OWNER, OR LESSEE OF AN ALARM SYSTEM THAT IS NEGLIGENTLY
OR ACCIDENTALLY ACTIVATED AS THE RESULT OF FAULTY,
MALFUNCTIONING, OR IMPROPERLY INSTALLED OR MAINTAINED EQUIPMENT
SHALL BE SUBJECT TO THE PROVISIONS OF SUBSECTIONS (B), (C), AND
(D) AND (C) OF THIS SECTION.
(B) BURGLARY ALARM SYSTEMS AND ROBBERY ALARM SYSTEMS SHALL
BE CONSIDERED SEPARATE SYSTEMS PER PREMISES AND CALCULATED ON AN
INDIVIDUAL BASIS.
(C) (B) A LAW ENFORCEMENT AGENCIES AGENCY MAY ISSUE A CIVIL
CITATION TO AN ALARM USER IF THE NUMBER OF FALSE ALARMS TO WHICH
THE ANY LAW ENFORCEMENT AGENCIES ACTUALLY RESPOND AGENCY ACTUALLY
RESPONDS EXCEEDS:
(1) 3 RESPONSES WITHIN A 30-DAY PERIOD; OR
(2) 8 OR MORE IN RESPONSES WITHIN A 12-MONTH PERIOD.
(D) (C) THE CIVIL CITATION SHALL INCLUDE A FINE OF:
(1) $30 FOR EACH INITIAL FALSE ALARM; AND
(2) $30 FOR EACH ADDITIONAL FALSE ALARM.
(E) ALL FUNDS COLLECTED AS A RESULT OF CIVIL CITATIONS
SHALL ACCRUE TO THE BENEFIT OF THE ISSUING LAW ENFORCEMENT
AGENCY'S OPERATION BUDGET.

(A) IN THIS SECTION AN ALARM SYSTEM IS DEEMED A DEFECTIVE
ALARM SYSTEM IF:
(1) MORE THAN 3 FALSE ALARMS OCCUR WITHIN A 30-DAY
PERIOD; OR
