AN ACT concerning
Nursing Shortage - Higher Education Tuition Fees -
Health Occupation Courses and Programs
FOR the purpose of allowing certain students who are not
residents of this State and who enroll in certain education
courses or programs leading to licensure in certain health
occupations at certain public institutions of higher
education to pay tuition and other mandatory fees at the
same rate as residents of this State under certain
circumstances; providing for a termination of the tuition
reduction program under certain circumstances; requiring the
State Board for Higher Education to report to the
Legislative Policy Committee annually concerning student
participation in the program; and generally relating to
higher education tuition fees.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

11-104.
(A) ANY STUDENT ATTENDING A PUBLIC INSTITUTION OF HIGHER
EDUCATION WHO IS NOT A RESIDENT OF THIS STATE AND WHO IS ENROLLED
IN AN EDUCATION COURSE OR PROGRAM LEADING TO LICENSURE IN A
HEALTH OCCUPATION AN OCCUPATION AS A LICENSED REGISTERED NURSE OR
A LICENSED PRACTICAL NURSE SHALL PAY ONLY THE TUITION FEES AND
OTHER MANDATORY FEES PAYABLE BY A RESIDENT OF THIS STATE IF:
(1) THE EDUCATION COURSE OR PROGRAM IS FOR A HEALTH
OCCUPATION, INCLUDING NURSING, DETERMINED TO BE IN SHORT SUPPLY
BY THE STATE BOARD FOR HIGHER EDUCATION AFTER CONSULTATION WITH
THE SECRETARY OF HEALTH AND MENTAL HYGIENE; AND
(2) THE STUDENT FURNISHES A SURETY BOND OR GUARANTEED
PROMISSORY NOTE TO THIS STATE, WITH SECURITY SATISFACTORY TO THE
STATE BOARD FOR HIGHER EDUCATION, THAT, ON COMPLETION OF THE
EDUCATION COURSE OR PROGRAM, THE STUDENT WILL WORK IN THIS STATE
