(1) SUBJECT TO ITEM (2) OF THIS SUBSECTION, SERVICE
OF PROCESS ON THE EXECUTIVE DIRECTOR OF THE COMMISSION BINDS ANY
PERSON WHO HAS FILED A CONSENT WITH THE COMMISSION, AS REQUIRED
UNDER THIS SECTION.
(2) IF SERVICE OF PROCESS IS MADE ON THE EXECUTIVE
DIRECTOR OF THE COMMISSION AS AUTHORIZED UNDER THIS SECTION, THE
PERSON FILING IMMEDIATELY SHALL:
(I) SUBMIT A COPY OF THE FILING TO THE
COMMISSION; AND
(II) SEND A COPY OF THE FILING, BY CERTIFIED
MAIL, RETURN RECEIPT REQUESTED, TO THE PRINCIPAL OFFICE OF THE
PERSON AGAINST WHOM THE ACTION, SUIT, OR PROCEEDING IS DIRECTED.
(3) AS TO ANY PERSON WHO FILES A CONSENT AS REQUIRED
UNDER THIS SECTION, ANY ACTION, SUIT, OR PROCEEDING MAY BE
BROUGHT IN ANY COUNTY OF THE STATE IN WHICH:
(I) THE CAUSE OF ACTION AROSE; OR
(II) THE PLAINTIFF RESIDES.
SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from the first and fourth
sentences of former Art. 56, § 219(d).
In subsections (b) and (d) of this section, the
language "executive director of the Commission" has
been substituted for the former language "secretary of
the Commission" to reflect that the title of the
position was changed by Ch. 506, Acts of 1966.
In subsection (c) of this section, new language is
added to state expressly that which was only implied
in the former law — i.e., that the Commission may not
issue a license to a nonresident applicant, unless the
nonresident applicant complies with the requirements
of this section regarding filing a consent.
The second and third sentences of former Art. 56, §
219(d), which purported to impose additional
consent-related requirements on out of state firms
that apply for a license, are deleted as erroneous,
since under current law the Commission may only grant
a license to an individual.
