Subsection (d) of this section is new language that,
in part, is derived without substantive change from
former Art. 56, § 223(b) and, in part, is added to
provide a uniform examination fee for all applicants
for examinations.
Subsection (e) of this section is new language derived
without substantive change from former Art. 56, §
217(c)(3) and the second sentence of (c)(1).
Subsection (f)(1) of this section is new language
derived from the reference in former Art. 56, §
223(b), to a testing service, and rephrased to state
expressly that the Commission may use a service for
the administration of examinations.
Subsection (f)(2) of this section is new language
added to state expressly that, subject to the
requirements set by the Commission, it may delegate to
the testing service responsibility for setting the
time and place of examinations and for notifying
applicants.
In the introductory language of subsection (d) of this
section, the term "applicant" is substituted for the
former term "resident applicants", on the
recommendations of the Joint Subcommittee on the
Business Occupations Article, to establish a uniform
examination fee for resident and nonresident
applicants in conformity with changes in the fee
structure made throughout this title. See the General
Subcommittee Comment to this title.
In subsection (d)(1) of this section, the former
reference to an examination "fee of $5" for a real
estate salesperson is deleted to provide a uniform
examination fee for all applicants for examinations.
In subsection (d)(2) of this section, the reference to
payment to the Commission is added to clarify that an
applicant shall pay the part of the examination fee
covering the cost of the examinations to either the
Commission or the testing service, according to the
arrangement established by the Commission.
Subsection (e)(1) of this section is restated in
standard language to indicate that it is the duty of
the Commission to determine the subjects, scope and
form of, and the passing score for the examinations
given under this title.
In subsection (e)(4) of this section, the language
"given on a particular date" is added to clarify that
