WILLIAM DONALD SCHAEFER, Governor

Ch. 563

EACH MEMBER OF THE COMMISSION IS ENTITLED TO:

(1)  COMPENSATION IN ACCORDANCE WITH THE STATE BUDGET;
AND

(2)  REIMBURSEMENT FOR EXPENSES UNDER THE STANDARD
STATE TRAVEL REGULATIONS, AS PROVIDED IN THE STATE BUDGET.

SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from former Art. 56, §
214(b), as it related to compensation for members, the
first sentence of § 215(c), and the first clause of §
229.

In subsection (a) of this section, the phrase "then
serving on the Commission" is added for clarity.

In subsection (b)(1) of this section, the standard
language "at the times and places that it determines"
is added for clarity.

Also in subsection (b)(1) of this section, the former
phrase "in public session" is deleted. The Commission
is a "public body", as defined in SG § 10-501(g), and,
thus, generally must meet in open session, SG §
10-505. However, SG § 10-508 specifically allows
closed sessions to discuss, e.g., personnel matters.
In light of the generally applicable provisions on
meetings of public bodies, in SG§§ 10-501 through
10-505, the second sentence and the first phrase of
the third sentence of former Art. 56, § 215(c), which
required public notice and allowed attendance at a
public hearing, are deleted.

As to subsection (c)(2) of this section, Standard
State Travel Regulations are adopted by the Department
of Personnel with the approval of the Board of Public
Works.

Former Art. 56, § 215(a), which required the
Commission to select its office, is deleted as
obsolete. Office space for the Commission is provided
through the Department.

Defined term: "Commission" § 4-101

4-205. EXECUTIVE DIRECTOR.

(A) POSITION AND TENURE.
