LAWS OF MARYLAND

the business occupation boards that the proposed
Business Occupations Article will govern.

The former phrase "of Maryland" is deleted from the
Commission title to avoid the use of the duplicative
terms "Maryland" and "State" and to correspond with
other board designations used in the proposed Business
Occupations Article.

Defined term: "Department" § 1-101

4-202. MEMBERSHIP.

(A)  COMPOSITION; APPOINTMENT OF MEMBERS.

(1)  THE COMMISSION CONSISTS OF 8 MEMBERS.

(2)  OF THE 8 COMMISSION MEMBERS:

(I)  5 SHALL BE LICENSED REAL ESTATE BROKERS,
LICENSED ASSOCIATE REAL ESTATE BROKERS, OR LICENSED REAL ESTATE
SALESPERSONS; AND

(II)  3 SHALL BE CONSUMER MEMBERS;

(3)  OF THE 5 PROFESSIONAL MEMBERS:

(I)  1 SHALL BE A RESIDENT OF ANY COUNTY IN THE
AREA THAT CONSISTS OF CECIL, CAROLINE, DORCHESTER, KENT, QUEEN
ANNE'S, SOMERSET, TALBOT, WICOMICO, AND WORCESTER COUNTIES;

(II)  1 SHALL BE A RESIDENT OF ANY COUNTY IN THE
AREA THAT CONSISTS OF BALTIMORE, CARROLL, HARFORD, AND HOWARD
COUNTIES;

(III)  1 SHALL BE A RESIDENT OF BALTIMORE CITY;

(IV)  1 SHALL BE A RESIDENT OF ANY COUNTY IN THE
AREA THAT CONSISTS OF ANNE ARUNDEL*, CALVERT, CHARLES, PRINCE
GEORGE'S, AND ST. MARY'S COUNTIES; AND

(V)  1 SHALL BE A RESIDENT OF ANY COUNTY IN THE
AREA THAT CONSISTS OF ALLEGANY, FREDERICK, GARRETT, MONTGOMERY,
AND WASHINGTON COUNTIES.

(4)  THE GOVERNOR SHALL APPOINT THE MEMBERS WITH THE
ADVICE OF THE SECRETARY AND WITH THE ADVICE AND CONSENT OF THE
SENATE.

(B)  QUALIFICATIONS OF ALL MEMBERS.

EACH COMMISSION MEMBER SHALL BE A CITIZEN OF THE STATE.
