WILLIAM DONALD SCHAEFER, Governor Ch. 558
(I) ANY ACTIVITY UNDERTAKEN FOR PROFIT,
INCLUDING THE SALE, PROVISION, ADVERTISEMENT, PROMOTION,
MARKETING, OR DISPLAY OF ANY GOODS OR SERVICES; AND
(II) EXCEPT AS PROVIDED IN PARAGRAPH (3) OF
THIS SUBSECTION, ALL STILL, MOTION, OR SOUND PICTURE PHOTOGRAPHY
AND SOUND RECORDING.
(2) COMMERCIAL ACTIVITY IS PERMITTED AT AN AIRPORT
OPERATED BY THE ADMINISTRATION ONLY WHEN EXPRESSLY AUTHORIZED BY
AND IN A MANNER PRESCRIBED BY THE ADMINISTRATION.
(3) IN CONFORMANCE WITH PARAGRAPH (4) OF THIS
SUBSECTION, "COMMERCIAL ACTIVITY" MAY NOT INCLUDE:
(I) PROFESSIONAL PHOTOGRAPHERS AND MOTION
PICTURE TECHNICIANS PHOTOGRAPHING EVENTS ON ANY PART OF THE
AIRPORT AS DULY AUTHORIZED REPRESENTATIVES OF NEWS GATHERING
AGENCIES OR BONA FIDE NEWS PUBLICATIONS; AND
(II) PROFESSIONAL PHOTOGRAPHERS PHOTOGRAPHING
SCENES ON ANY PART OF THE AIRPORT FOR GENERAL ARTISTIC PURPOSES.
(4) ANY PERSON CONDUCTING ACTIVITIES UNDER PARAGRAPH
(3) OF THIS SUBSECTION SHALL:
(I) GIVE THE STATE AVIATION ADMINISTRATOR OR
THE ADMINISTRATOR'S DESIGNEE PRIOR NOTIFICATION OF INTENT TO
CONDUCT THOSE ACTIVITIES ON ANY PART OF THE AIRPORT;
(II) CONDUCT THOSE ACTIVITIES CONSISTENT WITH
THE PUBLIC HEALTH, SAFETY, AND WELFARE; AND
(III) ABIDE BY ALL APPLICABLE FEDERAL AND STATE
AVIATION ADMINISTRATION SECURITY RULES AND REGULATIONS.
(5) ANY PERSON WHO VIOLATES PARAGRAPH (4)(I) OF THIS
SUBSECTION SHALL BE SUBJECT TO CIVIL SANCTIONS ONLY.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.
