WILLIAM DONALD SCHAEFER, Governor Ch. 537

SECTION 2 AND BE IT FURTHER ENACTED, That it is the intent
of the General Assembly that there shall be grant money in the
State Budget for fiscal year 1990 totaling at least $500,000 to
assist counties that have populations of less than 150,000 in the
preparation of recycling plans. If these funds are not included
in the budget for fiscal year 1990, a county with a population of
less than 150,000 shall have until July 1, 1991 to develop a
recycling plan under § 9-505 of the Environment Article.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect on July 1, 1988.

(Senate Bill 94)

AN ACT concerning

Environmental Health - Phosphate Ban - Repeal of Sunset

FOR the purpose of repealing the provision of law that terminates
the ban on the use of phosphates in certain cleaning agents
as of a certain date.

BY repealing and reenacting, with amendments,

Chapter 526 of the Acts of the General Assembly of 1985, as
amended by Chapter 5 of the Acts of the General
Assembly of 1986

Section 4

Preamble

WHEREAS, Recognizing the detrimental effect of phosphates on
the Chesapeake Bay, in 1985, the General Assembly enacted
legislation to ban the use of phosphates in cleaning agents; and

WHEREAS, The legislation banning the use of phosphates in
cleaning agents has a termination date of December 1, 1989; and

WHEREAS, A study by the Office of Environmental Programs of
the discharge from sewage treatment plants before and after the
ban on phosphate detergents shows that the ban has eliminated
nearly one-quarter of all phosphorous going into the Chesapeake
Bay from sewage treatment plants, and that local governments have
