Ch. 518 LAWS OF MARYLAND

Preamble
WHEREAS, The University of Maryland Medical System
Corporation (UMMS) is a private, not for profit corporation that
was established pursuant to Chapter 288 of the Acts of 1984; and
WHEREAS, As a result of Chapter 288 of the Acts of 1984, a
dual personnel system was created that required UMMS to utilize
both noncorportion ("State") personnel and corporation
("Corporate") employees; and
WHEREAS, The dual personnel system has not only caused UMMS
undue financial hardship, it has also had a demoralizing impact
upon the System's employees because of the various inequities
that exist between the two personnel systems; and
WHEREAS, In an effort to help resolve such problems, funds
have been included in the Fiscal Year 1989 State Budget to
implement a voluntary transfer incentive program whereby State
employees will be encouraged to transfer to the corporate
personnel system; and
WHEREAS, The General Assembly believes that State employees
who do voluntarily transfer to the corporate personnel system
should be allowed to continue to participate in and remain
members of the Maryland State Retirement and Pension Systems
under the same terms and conditions that they presently enjoy;
now, therefore,
WHEREAS, The University of Maryland Medical System
Corporation was created by Chapter 288 of the Acts of the General
Assembly of 1984; and
WHEREAS, It was understood at the time that University
personnel would have the option to become employees of the
Corporation, but could elect to remain as University personnel
without any impairment of their rights and privileges; and
WHEREAS, It is the intent of the General Assembly to keep
its commitment to the employees of the Corporation and the State
employees; now, therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
