IF THE POSITION OF COUNTY ADMINISTRATOR BECOMES VACANT
DURING THE COUNTY ADMINISTRATOR'S 4-YEAR CONTRACT PERIOD, THE
BOARD OF COUNTY COMMISSIONERS MAY APPOINT AN ACTING COUNTY
ADMINISTRATOR WHO QUALIFIES UNDER 4 1-42 OF THIS ARTICLE TO SERVE
THE REMAINDER OF THE 4-YEAR TERM.

(A) NOTWITHSTANDING § 1-41 OF THIS ARTICLE, THE BOARD OF
COUNTY COMMISSIONERS MAY REMOVE A COUNTY ADMINISTRATOR FOR
GROUNDS PERTAINING TO THE COUNTY ADMINISTRATOR'S PERFORMANCE, IN
ACCORDANCE WITH SUBSECTION (B) OF THIS SECTION.

(B) PRIOR TO REMOVAL OF A COUNTY ADMINISTRATOR, THE BOARD
OF COUNTY COMMISSIONERS SHALL GIVE THE COUNTY ADMINISTRATOR:

(1) 30 DAYS NOTICE;

(2) A WRITTEN STATEMENT OF REASONS JUSTIFYING THE
REMOVAL; AND

(3) A PUBLIC HEARING, IF REQUESTED, REVIEWING THE
GROUNDS FOR REMOVAL AFTER GIVING THE COUNTY ADMINISTRATOR AT
LEAST 30 DAYS' NOTICE.

SECTION 2. AND BE IT FURTHER ENACTED, That notwithstanding
the 4-year contract provision of this Act, a committee as
provided in 4 1-44 shall recommend 3 candidates who qualify under
this Act to the County Commissioners by December 1, 1988, and the
County Commissioners shall hire a County Administrator for a
2-year probationary period beginning in 1989. The candidate
selected shall be considered for a 4-year contract by the
successor Board of Commissioners in 1991.

SECTION 3. 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1988.
