LAWS OF MARYLAND

(3)  IN A JUDICIAL PROCEEDING AUTHORIZED BY THIS
SECTION, THE SOLE ISSUES SHALL BE WHETHER THE COUNTY
COMMISSIONERS ACTED IN ACCORDANCE WITH:

(I) PROCEDURES CONCERNING COUNTY ORDINANCES IN
ARTICLE 25, § 3(R) OF THE ANNOTATED CODE OF MARYLAND;

(II)  THE REQUIREMENTS OF THIS SECTION; OR

(III)  OTHER PROCEDURES REQUIRED BY LAW.

(4)  ISSUES SUBJECT TO REVIEW UNDER THIS SECTION SHALL
BE DECIDED BY THE COURT WITHOUT A JURY.

(5)  THE COUNTY MAY APPEAL A DECISION OF THE CIRCUIT
COURT UNDER THIS SECTION TO THE COURT OF SPECIAL APPEALS.

[D.] E. If the County Commissioners condemn any necessary
land for the use of roads, the procedures outlines in the
Annotated Code, Real Property Article, Title 12, and applicable
sections of Article 89B are to be followed.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.

AN ACT concerning

Vehicle Laws - Following Too Closely - Assessment of Points

FOR the purpose of altering the number of points that the Motor
Vehicle Administration is required to assess against an
individual who violates provisions of law relating to
following in a motor vehicle too closely to another vehicle.

BY renumbering

Article - Transportation

Section 16-402(a)(2) through 16-402(a)(27), respectively

to be Section 16-402(a)(3) through 16-402(a)(28),

respectively
