(4) (3) IN EACH INSTANCE, THE COURT SHALL ORDER THE
PERSON TO PAY THE FORFEITURE RESTITUTION TO THE STATE TREASURY
WHERE IT OF MARYLAND. MONEYS PAID UNDER THIS SECTION SHALL BE
CREDITED TO THE DEPARTMENT OF NATURAL RESOURCES TO BE USED ONLY
FOR THE REPLACEMENT, HABITAT MANAGEMENT, OR ENFORCEMENT PROGRAMS
FOR INJURED, KILLED, OR DESTROYED WILDLIFE OR PROTECTED SPECIES
OF ANIMAL.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.

AN ACT concerning
Surface Coal Mining - Replacement of Water Supplies
Impacted by Mining Operations
FOR the purpose of authorizing the Department of Natural
Resources to use funds in the Bituminous Coal Open-Pit
Mining Reclamation Fund from forfeiture of bonds for certain
purposes; authorizing the Department to use funds in the
Bituminous Coal Open-Pit Mining Reclamation Fund to replace
certain water supplies subject to certain reimbursement
requirements on the landowner and the operator; authorizing
a reserve within the Bituminous Coal Open-Pit Mining
Reclamation Fund to be used to replace certain water
supplies after release of all bonds on a permit and
providing a source of revenue for the reserve subject to
certain limitations; requiring that replacement of water
supplies occur prior to the release of all bonds on an
open-pit mine permit; authorizing the Department to replace
an impacted water supply after the bond covering a permit
has been forfeited; authorizing the Department to recover
certain amounts from an operator; and generally relating to
the replacement of water supplies impacted by mining
operations.
BY repealing and reenacting, without amendments,
