(3) Regulate the number of permits which may be
issued to organizations each year; and
(4) Deny a permit to an organization for up to 3
years if it violates the provisions of this section or the
regulations adopted under it.
(c) (1) The County Commissioners of Worcester County may
not issue more than 2 multiple gaming device permits in a year to
an organization if the permits are for fund raisers at which 2 or
more gaming devices will be used.
(2) A multiple gaming device permit issued under this
section for a fund-raiser at which 2 "or more gaming devices will
be used shall be valid for only [one 24-hour period] ONE EVENT
LASTING 6 HOURS.
(d) A multiple gaming device permit may not be issued for
utilization within the corporate limits of Ocean City or within
the boundaries of real property owned by Ocean City and located
in Worcester County.
(e) An organization which is issued a permit under this
section shall conduct the fund-raiser in:
(1) A structure owned, leased, or occupied by the
organization receiving the permit;
(2) A structure owned, leased, or occupied by any
organization which would qualify for a permit under subsection
(a) of this section; or
(3) A public location if it is described in the
permit application and is approved by the State's Attorney for
Worcester County.
(f) At least 50 percent of the funds derived from a
multiple gaming device fund-raiser that permits the use of 2 or
more gaming devices shall be used for a civic, charitable, or
educational purpose.
(g) A multiple gaming device permit may not be approved to
hold a fund-raiser on premises that are licensed under a Class B
or D alcoholic beverages license.
(h) More than 8 multiple gaming device permits may not be
issued to be held in any one facility in any one year. MORE THAN
3 MULTIPLE GAMING DEVICE PERMITS MAY NOT BE ISSUED TO BE HELD IN
ANY ONE FACILITY IN ANY 27-DAY PERIOD.
(i) (1) A fund-raiser conducted under this section shall be
managed and operated only by members of the organization that
receives the permit.
