(b) Any person violating the provisions of this section is

guilty of a felony and upon conviction is subject to imprisonment
for no more than the period of his natural life.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.

(House Bill 575)

AN ACT concerning

Alcoholic Beverages - Sales to Minors and Intoxicated Persons

FOR the purpose of repealing the requirement that the holder of
an alcoholic beverages license (licensee) has to have been a
certain person shall be found guilty of inducing an illegal
sale of alcoholic beverages before a finding of not guilty
or probation without a verdict in a certain proceeding
against a licensee under an alcoholic beverages license can
operate as a bar to certain further proceedings against the
licensee; and clarifying structure.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

118.

(a) (1) A licensee under the provisions of this article, or
any of his employees, may not sell or furnish any alcoholic
beverages at any time to a person under 21, and in the case of
beer and light wine, to a person not designated under § 2(t)(2)
of this article either for his own use or for the use of any
other person, or to any person who, at the time of the sale, or
delivery, is visibly under the influence of any alcoholic
beverage.
