CHAPTER 422

(House Bill 526)

AN ACT concerning

Harford County - Alcoholic Beverages License - Seasonal Use

FOR the purpose of including Harford County in the provisions of
law that authorize a seasonal use of an alcoholic beverages
license under certain circumstances; and authorizing the
Harford County Liquor Control Board to adopt regulations for
a certain purpose.

BY repealing and reenacting, with amendments,

Article 2B - Alcoholic Beverages

Section 75(e)

Annotated Code of Maryland

BY adding to

Article 2B - Alcoholic Beverages

Section 75(f)

Annotated Code of Maryland

(1987 Replacement Volume and 1987 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

75.

(e) (1) [In Wicomico County, if] IF the WICOMICO COUNTY
board of license commissioners OR THE HARFORD COUNTY LIQUOR
CONTROL BOARD determines that a licensed premise UNDER ITS
JURISDICTION is seasonally operated, the RESPECTIVE COUNTY board
may authorize the closing of the premises IN ITS RESPECTIVE
JURISDICTION for no more than 6 months.

(2) To qualify for this exception[, the]:

(I)  THE licensee shall submit a written request
to the RESPECTIVE COUNTY board [of license commissioners] at
least 30 days before the anticipated date of closing; AND

(II)  IN HARFORD COUNTY, THE LICENSEE SHALL ALSO
SUBMIT A WRITTEN REQUEST TO THE BOARD AT LEAST 30 DAYS BEFORE THE
ANTICIPATED DATE OF REOPENING.
