AN ACT concerning

Bad Checks - Uttering---Employers

FOR the purpose of expanding the criminal prohibition against
obtaining services by a bad check to include uttering by an
employer a person of a check for certain services by an

employee or independent contractor under certain

circumstances; providing certain presumptions, penalties,
and limits on prosecution; and generally relating to a
criminal prohibition against uttering by an employer a
person of a check for certain services by an employee or
independent contractor under certain circumstances.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

140.

In this subheading, the following words have the meanings
indicated:

(a)  "Check" means any check, draft, or other negotiable
instrument of any kind which is not postdated with respect to the
time of utterance.

(b)  "Drawer" of a check means a person whose name appears
thereon as the primary obligor, whether the actual signature be
that of himself or of a person purportedly authorized to draw the
check in his behalf.
