Ch. 382

LAWS OF MARYLAND

(a)  (1) A person 16 years old or older may not fish in any
special catch-and-return trout management area and may not
possess trout while fishing in nontidal waters unless the person
first obtains a trout stamp in addition to an angler's license.
The stamp shall be obtained from any authorized agent of the
Department at a cost of $3.50. If the resident applicant is 65
years old or older, the trout stamp costs $1. The Department may
designate a person engaged in a retail business to sell the trout
stamp as an agent under the Department's control and supervision.
The agent shall retain the sum of 15 cents as compensation for
every stamp he issues and sells. The trout stamps may be
furnished to agents upon consignment if the Department is given
adequate security to insure ultimate payment to the Department
for the stamps.

(2) The Department may sell expired stamps below face
value to the general public for a period of [120 days in
quantities not in excess of 3 sheets] 3 YEARS, after which time
the Department [may sell the entire lot of expired stamps or
previous issues to the highest bidder in lots of 10 sheets] SHALL
SHRED ANY UNSOLD STAMPS. All revenues derived from the sale of
these stamps shall revert back to the game management fund.

(b)  The Department may:

(1)  Order more stamps than necessary for license
purposes;

(2)  Issue official prints of the stamp illustration;

(3)  Sell stamps and prints to interested persons,
including dealers and collectors, provided that stamps may be
sold only for the price established as a stamp fee in subsection
(a) of this section;

(4)  Enter into a contract with a person or company to
handle publication, distribution, and sale of stamps and prints
under this subsection, with consideration being a percentage of
the profits; [and]

(5)  Sell or cause to be sold stamps and prints
outside of the State[.]; AND

(6)  SELL EXPIRED STAMPS BELOW FACE VALUE TO THE
GENERAL PUBLIC FOR A PERIOD OF 3 YEARS, AFTER WHICH TIME THE
DEPARTMENT SHALL SHRED ANY UNSOLD EXPIRED STAMPS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.
