Secretary of the Department of Housing and Community
Development; altering the number of certain staff of the
Regional Planning Council; and generally relating to the
members and staff of the Regional Planning Council.
BY repealing and reenacting, with amendments,
Article 78D - Regional Planning Council
Section 4(i) and 10
Annotated Code of Maryland
(1980 Replacement Volume and 1987 Supplement)
SECTION 1. BE IT ENACTED "" BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 78D - Regional Planning Council
4.
(i) The Secretary of State Planning, the Secretary of
Transportation, the Secretary of Natural Resources, THE SECRETARY
OF ECONOMIC AND EMPLOYMENT DEVELOPMENT, THE SECRETARY OF THE
ENVIRONMENT, THE SECRETARY OF HOUSING AND COMMUNITY DEVELOPMENT,
and the Secretary of Health and Mental Hygiene shall serve ex
officio as members of The Council, except that each ex officio
member may appoint an alternate as his representative to the
Council. Ex officio members and their alternates shall not have
voting rights and powers.

The employment, compensation, and tenure of an executive
officer may be made by the Regional Planning Council without
being subject to any of the provisions and restrictions of
Article 64A of the Annotated Code of Maryland, title "Merit
System." [Said] THE executive officer (with the approval of The
Council) may appoint [three] 4 additional department or section
heads without being subject to the provisions and restrictions of
Article 64A of the Annotated Code of Maryland, title "Merit
System." The Council may also employ or retain counsel or
consultants without being subject to the provisions and
restrictions of Article 64A of the Annotated Code of Maryland,
title "Merit System." All other employees of The Council shall
be subject generally to the provisions and restrictions of
Article 64A of the Annotated Code of Maryland, title "Merit
System."
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.
