CHAPTER 307

(Senate Bill 419)

AN ACT concerning

Waterway Improvement Fund - Pump-Out Stations at
Public and Private Marinas

FOR the purpose of allowing money in the Waterway Improvement
Fund to be used to construct pump-out stations for use by
the general boating public at public and private marinas;
allowing the Secretary of Natural Resources the sole
discretion to use funds under this Act to install pump-out
stations for use by the general boating public or to
supplement operational maintenance costs; requiring the
Secretary to consult with the Department of the Environment
on certain matters; allowing the Department of Natural
Resources to adopt regulations for certain purposes under
this Act; providing for the financing of the construction of
pump-out stations for use by the general boating public at
public and private marinas; and generally relating to the
use of money in the Waterway Improvement Fund for certain
purposes related to pump-out stations for use by the general
boating public at public and private marinas in the State.

BY repealing and reenacting, with amendments,

Section 8-707(4) and 8-708(a) and (b)

Annotated Code of Maryland

(1983 Replacement Volume and 1987 Supplement)

Preamble

WHEREAS, Until now, the Waterway Improvement Fund has been
used, among other purposes, to fund the installation of pump-out
facilities for use by vessels of the general boating public that
use public property; and

WHEREAS, There are no laws or regulations that require
public or private marinas to provide pump-out facilities for use
by the general boating public; and

WHEREAS, In order to encourage owners of vessels 65 feet in
length and less to obey the regulations concerning marine
sanitation devices that are built and certified to meet U.S.
Coast Guard standards, it is necessary that adequate pump-out
facilities for use by the general boating public be made
available to those vessels on public and private property; now,
therefore,
