Ch. 305

LAWS OF MARYLAND

TIME IN THE CALENDAR YEAR SPECIFIED BY THE COMMISSION UNDER THE
TERMS AND CONDITIONS THAT THE COMMISSION MAY DEEM APPROPRIATE.

(C)  THE MARYLAND RACING COMMISSION MAY APPROVE AN
APPLICATION FOR AN INTRASTATE SIMULCASTING LICENSE IF:

(1)  THE IN-STATE RECEIVING TRACK DEMONSTRATES TO THE
SATISFACTION OF THE COMMISSION THAT IT HAS CONDUCTED, IS
CONDUCTING, OR WILL CONDUCT REGULARLY SCHEDULED HORSE RACE
MEETINGS IN ACCORDANCE WITH A LICENSE ISSUED BY THE COMMISSION,
AND HAS COMPLIED WITH THE TERMS OF THE LICENSE;

(2)  THE IN-STATE SENDING TRACK RECEIVES APPROVAL OF
ITS INTRASTATE SIMULCASTING AGREEMENT FROM THE HORSEMEN'S
ORGANIZATIONS AT ITS TRACK; AND

(3)  THE IN-STATE RECEIVING TRACK HAS RECEIVED
APPROVAL OF ITS INTRASTATE SIMULCASTING AGREEMENT FROM THE
HORSEMEN'S ORGANIZATIONS AT ITS TRACK WHEN THE INTERTRACK
WAGERING IS TO OCCUR AT THE IN-STATE RECEIVING TRACK DURING A
PERIOD WHEN THE IN-STATE RECEIVING TRACK IS CONDUCTING A LIVE
RACE MEETING LIVE RACING IS BEING CONDUCTED, OR THE HORSEMEN'S
ORGANIZATIONS FROM THE PREVIOUS LIVE MEET IF LIVE RACING IS NOT
BEING CONDUCTED AT THE IN-STATE RECEIVING TRACK.

(D)  (1) ALL MONEY WAGERED AT THE IN-STATE RECEIVING TRACK
ON INTRASTATE SIMULCAST HORSE RACES SHALL BE INCLUDED IN THE
APPLICABLE MUTUEL POOLS AT THE INSTATE IN-STATE SENDING TRACK AND
SHALL, FOR ALL PURPOSES, BE CONSIDERED AS IF WAGERED AT THE
IN-STATE SENDING TRACK.

(2)  COMPUTATION OF THE TAKEOUT, BREAKAGE, AND STATE
TAX ON ALL INTERTRACK WAGERING AT THE IN-STATE RECEIVING TRACK
SHALL BE THE SAME AS THAT NORMALLY APPLICABLE TO RACING CONDUCTED
AT THE IN-STATE SENDING TRACK.

(3) AFTER DEDUCTING FROM THE TAKEOUT THE APPLICABLE
STATE TAX, THE AMOUNT TO BE RETAINED BY THE IN-STATE RECEIVING
TRACK UNDER THE TERMS OF THE INTRASTATE SIMULCASTING AGREEMENT,
AND THE COST TO THE IN-STATE SENDING TRACK OF THE TRANSMISSION,
THE REMAINDER SHALL BE ALLOCATED IN THE SAME PROPORTIONS AS
NORMALLY APPLICABLE TO RACING CONDUCTED AT THE IN-STATE SENDING
TRACK, EXCEPT THAT 5 PERCENT OF THE ALLOCATIONS TO THE IN-STATE
SENDING TRACK, TO THE MARYLAND BRED RACE FUND, AND FOR PURSES
SHALL BE PAID TO THE RACING COMMISSION FOR THE USE OF THE STATE.

(E)  ALL PARI-MUTUEL INFORMATION REGARDING THE MONEY WAGERED
AT THE IN-STATE RECEIVING TRACK SHALL BE:

(1) TRANSMITTED DIRECTLY TO THE IN-STATE SENDING
TRACK; AND
