THE COMPTROLLER SHALL ISSUE A LICENSE OF THE APPROPRIATE
CLASS TO EACH APPLICANT WHO MEETS THE REQUIREMENTS OF THIS
SUBTITLE.

(B) EXEMPTION CERTIFICATE.

THE COMPTROLLER SHALL ISSUE AN EXEMPTION. CERTIFICATE TO EACH
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
140(j)(l) and (2).

In subsections (a) and (b) of this section, the former
references to licenses and exemption certificates
being "subject to cancellation as provided by law" are
deleted as unnecessary in light of the specific
cancellation provisions. See § 9-330 of this
subtitle.

In subsection (a) of this section, the phrase "of the
appropriate class" is added for clarity.

Also in subsection (a) of this section, the former
reference to approval of the bond is deleted as
unnecessary in light of § 9-320(a)(2) of this subtitle
and the referenced Title 13.

9-322. SCOPE OF LICENSE AND EXEMPTION CERTIFICATE.

(A)  CLASS "A" LICENSE.

A CLASS "A" LICENSE AUTHORIZES THE LICENSEE TO:

(1)  IMPORT MOTOR FUEL INTO THIS STATE;

(2)  EXPORT MOTOR FUEL FROM THIS STATE; AND

(3)  ACQUIRE FROM OTHER HOLDERS OF A CLASS "A" LICENSE
MOTOR FUEL EXEMPTED FROM THE MOTOR FUEL TAX.

(B)  CLASS "B" LICENSE.

(1)  A CLASS "B" LICENSE AUTHORIZES THE LICENSEE TO
IMPORT MOTOR FUEL FOR PERSONAL USE OR FOR REDISTRIBUTION.

(2)  A HOLDER OF A CLASS "B" LICENSE MAY NOT ACQUIRE
IN THIS STATE:

(I) GASOLINE, OTHER THAN AVIATION GASOLINE,
THAT IS EXEMPT FROM THE MOTOR FUEL TAX; OR
