(ii) After the investigation, report the
findings to the complainant.

(4)  After receipt of the report, the complainant
shall be given an opportunity for a hearing BEFORE THE DEPARTMENT
in accordance with the rules and regulations that the Department
adopts.

(5)  THE DIRECTOR ON AGING OR THE DIRECTOR'S DESIGNEE
MAY REQUEST A HEARING AND ACT AS A REPRESENTATIVE OF THE RESIDENT
AT THE HEARING UNDER PARAGRAPH (4) OF THIS SUBSECTION WHEN:

(I) THERE IS NO GUARDIAN, PERSONAL

REPRESENTATIVE, ABLE AND AVAILABLE OR FAMILY MEMBER ABLE,
WILLING, OR AND AVAILABLE TO FILE; AND

(II) THE RESIDENT CONSENTS.

(6)  THE DIRECTOR ON AGING OR THE DIRECTOR'S DESIGNEE
MAY, IN ANY HEARING UNDER PARAGRAPH (4) OF THIS SUBSECTION TO
WHICH IT IS NOT A PARTY UNDER PARAGRAPH (5) OF THIS SUBSECTION,
TAKE PART AS AN INTERESTED PARTY.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.
