Ch. 269

QUESTION ANTICIPATED RENTAL PERIOD OR THE ANTICIPATED TOTAL DAILY
CHARGE; AND

(5)  THE AGREEMENT CONTAINING THE COLLISION DAMAGE
WAIVER DISPLAYS SHALL DISPLAY THE FOLLOWING NOTICE ON THE FACE OF
THE AGREEMENT, SET APART AND IN BOLDFACE TYPE, AND IN TYPE AT
LEAST AS LARGE AS 10 POINT TYPE:

"NOTICE: THIS CONTRACT OFFERS, FOR AN ADDITIONAL CHARGE,
A COLLISION DAMAGE WAIVER TO COVER YOUR RESPONSIBILITY FOR
DAMAGE TO THE VEHICLE. BEFORE DECIDING WHETHER TO PURCHASE
THE COLLISION DAMAGE WAIVER, YOU MAY WISH TO DETERMINE
WHETHER YOUR OWN AUTOMOBILE INSURANCE AFFORDS YOU COVERAGE
FOR DAMAGE TO THE RENTAL VEHICLE AND THE AMOUNT OF THE
DEDUCTIBLE UNDER YOUR OWN INSURANCE COVERAGE. THE PURCHASE
OF THIS COLLISION DAMAGE WAIVER IS NOT MANDATORY AND MAY BE
WAIVED." WAIVED."; AND

(6)  ANY ADDITIONAL INFORMATION THAT THE DIVISION
CONSIDERS REASONABLE AND NECESSARY TO CARRY OUT THE PROVISIONS OF
THIS SUBTITLE.

(D) (F) A FAILURE BY A LESSOR TO COMPLY WITH SUBSECTION (B)
(D) OF THIS SECTION IS AN UNFAIR OR DECEPTIVE TRADE PRACTICE
WITHIN THE MEANING OF TITLE 13, SUBTITLE 3 OF THE COMMERCIAL LAW
THIS ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988 January 1, 1989.

AN ACT concerning

Motor Vehicle Rental - Daily Rental Rates

FOR the purpose of requiring any person who rents a motor vehicle
to another person a consumer to adhere to certain daily rate
computation practices; providing that any person who rents a
motor vehicle to a consumer shall make a certain notation on
the rental agreement regarding daily rate computation;
requiring that any person who rents a motor vehicle to a
consumer provide the consumer with certain information;
providing that a violation of any provision of the Act is an
unfair and deceptive trade practice; and generally relating
