PART III. LICENSING OF DEALERS, SPECIAL FUEL
SELLERS, AND SPECIAL FUEL USERS.

9-318. LICENSE REQUIRED.

A PERSON SHALL BE LICENSED BY THE COMPTROLLER BEFORE THE
PERSON MAY ENGAGE IN THE BUSINESS OF:

(1)  A DEALER;

(2)  A SPECIAL FUEL SELLER; OR

(3)  A SPECIAL FUEL USER.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
140(a)(1) and the first sentences of (c) through (e).

This section is rephrased in standard language to
state affirmatively that a person must be licensed to
engage in a regulated business in the State.

Former Art. 56, § 140(a)(2), which excluded a holder
of an exemption certificate, is deleted since these
holders may be licensees. See § 9-319 of this
subtitle.

9-319. QUALIFICATIONS OF APPLICANTS.

(A)  CLASS "A" LICENSE.

TO QUALIFY FOR A CLASS "A" LICENSE, AN APPLICANT SHALL:

(1) BE A PRODUCER, REFINER, OR ANY OTHER ENTITY THAT
MANUFACTURES MOTOR FUEL EXCEPT FOR BLENDS OF ALCOHOL AND GASOLINE
OTHER THAN AVIATION GASOLINE;

(2) OWN OR CONTROL AND DEDICATE AT LEAST 1 MILLION
GALLONS OF STORAGE CAPACITY IN THE STATE TO GASOLINE, OTHER THAN
AVIATION GASOLINE, AND TO SPECIAL FUEL; AND

(3) KEEP IN THE STATE AN INVENTORY OF AT LEAST
500,000 GALLONS OF THAT GASOLINE AND SPECIAL FUEL.

(B)  CLASS "B" LICENSE.
