the Governor in the budget to pay any costs incurred as a result
of contract termination in whole or in part.
(2)] The President of the Senate and the Speaker of
the House of Delegates shall appoint a special committee composed
of 3 Senators and 3 Delegates who shall regularly consult with
the Secretary OF TRANSPORTATION AND THE SECRETARY OF THE
ENVIRONMENT on the administration of the program and [the] ANY
contract in accordance with the terms of these provisions.
23-204.
The [inspection] facilities established under [the program]
§ 23-203 OF THIS SUBTITLE shall conduct [inspection of motor
vehicles to determine whether each vehicle complies with the
emission standards established under this subtitle for that
vehicle] THE ANNUAL EXHAUST EMISSIONS TEST OR THE BIENNIAL
EXHAUST EMISSIONS TEST AND EMISSIONS EQUIPMENT AND MISFUELING
INSPECTIONS OF MOTOR VEHICLES TO DETERMINE WHETHER EACH VEHICLE
COMPLIES WITH EMISSION STANDARDS ESTABLISHED UNDER THIS SUBTITLE
FOR THAT VEHICLE.
23-205.
(a) The Administration AND THE SECRETARY shall set the fee
to be charged for each vehicle to be inspected [under the
program] AND TESTED BY A FACILITY.
[(1) The fee shall not exceed $9.
(2)] (B) (1) The fee shall be collected [by the
inspecting facility at the time of the inspection] IN A MANNER
ESTABLISHED BY THE ADMINISTRATION AND THE SECRETARY.
(2) THE ADMINISTRATION AND THE SECRETARY SHALL
PROVIDE FOR THE PAYMENT OF THE FEE BY CASH OR PERSONAL CHECK.
(3) IN ADDITION TO ANY OTHER REMEDY, IF A PERSON'S
PAYMENT BY CHECK IS REFUSED BECAUSE OF INSUFFICIENT FUNDS, THE
ADMINISTRATION MAY SUSPEND THE PERSON'S VEHICLE REGISTRATION.
[(b)] (C) A specific portion of the fee shall be paid to OR
RETAINED BY the [Administrator] ADMINISTRATION to cover the cost
of supervision ADMINISTRATION AND ENFORCEMENT OF THE VEHICLE
EMISSIONS INSPECTION PROGRAM, as provided in the contract between
the contractor and the [Administration] STATE.
23-206.
(a) An owner of a motor vehicle that is registered in this
State shall have the vehicle inspected AND TESTED AND TESTED, as
required under this subtitle.
