AN ACT concerning

State Building Energy Utilization Guidelines

FOR the purpose of repealing the provisions of law concerning the
State building energy utilization guidelines.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(a)  (1) In this section the following terms have the
meanings indicated.

(2)  "ASHRAE" means the organization known as the
American Society of Heating, Refrigerating, and Air Conditioning
Engineers.

(3)  "Department" means the Department of Housing and
Community Development.

(4)  "Secretary" means Secretary of Housing and
Community Development.

(b)  (1) The Department shall develop statewide energy
utilization guidelines that are applicable to all new buildings
for which a building or zoning permit is issued and not exempted
by the local jurisdictions.

(2)  In developing the State guidelines, the
Department shall utilize the most recent ASHRAE standard, "Energy
Conservation in New Building Design".

(3)  After approval by the AELR Committee of the
Maryland General Assembly, these guidelines will be promulgated.
Based on the State guidelines, as approved by the AELR Committee,
each local jurisdiction shall require each permit application to
