(2) IF THE COMMISSIONER FINDS A VIOLATION, THE
COMMISSIONER SHALL DETERMINE THE AMOUNT OF LIQUIDATED DAMAGES AND
RESTITUTION TO BE ASSESSED FOR THE VIOLATION.
(3) ON THE ENTRY AND SERVICE OF A COMMISSIONER'S
ORDER, THE PUBLIC BODY, FROM THE MONEY DUE THE CONTRACTOR OR
SUBCONTRACTOR, SHALL:
(I) PAY THE AFFECTED EMPLOYEES THE FULL AMOUNT
OF WAGES DUE THEM; AND
(II) SATISFY LIQUIDATED DAMAGES THE OBLIGATION
OF THE CONTRACTOR OR SUBCONTRACTOR TO PAY LIQUIDATED DAMAGES AS
REQUIRED UNDER § 17-222 OF THIS SUBTITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the fourth sentence of
former SF § 12-304(b) and § 12-307(a), (b), (c), (e),
and the first sentence of (d) and the second sentence
of (d), as that sentence related to the Commissioner's
power to determine the amounts of restitution and
liquidated damages.
In the introductory language of subsection (a) of this
section, the former reference to "agents and officers"
is deleted as included in the term "public body".
In subsection (a)(1) of this section, the word
"performance" is substituted for the former word
"execution", for clarity.
In subsection (a)(2) of this section, the reference to
amounts owed "to its employees or the public body" is
added for clarity.
In subsection (c)(3) of this section, the word
"straight" is substituted for the former word
"regular", to modify the term "prevailing wage rates",
to conform to similar language in other sections of
this subtitle.
In subsection (e)(2)(i) of this section, the reference
"equal to" is substituted for the former reference to
"sufficient sums to cover", for clarity.
The introductory language of subsection (i) of this
section, "[a]fter ... the hearing", is substituted for
the former language "upon such hearing and
investigation", for clarity since the investigation
precedes the hearing.
In the introductory language of subsection (h)(1) of
this section, the word "quasi-judicial" is substituted
