"records of each of his subcontractors". The latter
seemingly would encompass work off the site.

In the introductory language of subsection (c) of this
section, the words "for the subcontractor's records"
are substituted for the former words "as the case may
be", for clarity.

In subsection (c)(2) of this section, the reference to
the rates "paid" is substituted for the former
reference to the rates "contained therein" for
clarity.

In subsection (c)(4) of this section, the former words
"as the case may be" are deleted as unnecessary in
light of the introductory language of subsection (c)
of this section.

In the introductory language of subsection (d) of this
section, the reference to the records "required under
subsection (b) of this section" is substituted for the
former reference to "any of his contractors'" records,
for clarity;

Subsection (d)(1) of this section is revised to state
affirmatively that the "public body" may perform the
act described in that item;

In subsection (d)(1) of this section, the word
"postpone" is substituted for the former words "be
held in abeyance", for clarity and brevity.

17-221. COMPLAINTS; INVESTIGATIONS; HEARINGS.

(A)  COMPLAINTS MADE TO PUBLIC BODY.

EACH PUBLIC BODY THAT AWARDS A PUBLIC WORK CONTRACT SHALL:

(1)  TAKE COGNIZANCE OF A COMPLAINT OF A VIOLATION OF
THIS SUBTITLE COMMITTED IN THE COURSE OF PERFORMANCE OF THE
PUBLIC WORK CONTRACT; AND

(2)  WHEN MAKING PAYMENTS TO THE CONTRACTOR, WITHHOLD
ANY AMOUNT THAT THE CONTRACTOR OWES TO ITS EMPLOYEES OR THE
PUBLIC BODY AS A RESULT OF THE VIOLATION.

(B)  INVESTIGATION BY COMMISSIONER.
