Subsection (b)(1) of this section is revised to
clarify that the petitioner must send the copy to the
public body.

In subsection (b)(2) of this section, the reference to
"a copy of the petition" is substituted for the former
reference to "notice of the filing of such petition",
to conform to subsection (b)(1) of this section.

Also in subsection (b)(2) of this section, the former
reference to 5 days after the "determination" is
deleted as inconsistent with the reference to 5 days
after publication since the 2 events would rarely, if
ever, coincide.

Also in subsection (e) of this section, the phrase "in
writing", which formerly modified "determination", is
deleted as unnecessary in light of the substantive
requirements of § 11-207(1) of this article.

17-212. VOTING ON PUBLIC WORK CONTRACTS.

A MEMBER OF A PUBLIC BODY MAY NOT VOTE FOR THE AWARD OF A
PUBLIC WORK CONTRACT OR VOTE TO DISBURSE MONEY FOR THE
CONSTRUCTION OF A PUBLIC WORK UNLESS:

(1)  THE PUBLIC BODY HAS ASKED THE COMMISSIONER TO
DETERMINE THE PREVAILING WAGE RATES IN THE LOCALITY FOR EACH
CLASSIFICATION OF WORKER REQUIRED TO PERFORM THE PUBLIC WORK
CONTRACT; AND

(2)  THE DETERMINATION HAS BEEN MADE PART OF THE
SPECIFICATIONS AND PUBLIC WORK CONTRACT FOR THE PUBLIC WORK.
