Council sets the prevailing wage rate for apprentices
based on a percentage of the rate determined by the
Commissioner for mechanics in the same trade. That
practice is stated in the revised language of
subsection (e) of this section. Similarly, in
subsection (d)(2)(i) of this section, the former
references to fringe benefit costs of "apprentices"
are deleted since these costs should not affect a
prevailing wage rate determination made only for
workers.
In subsection (b)(1)(ii) of this section, the defined
term "public work" is substituted for the former
reference to a "undertaking", for clarity.
In the introductory language of subsection (c)(1) of
this section, the phrase "in construction", which
formerly modified the word "classification", is
deleted as misleading. Many workers covered by this
subtitle, such as plumbers, are not readily considered
to be working in a "construction" classification.
In subsection (d)(1) of this section, the phrase "to a
3rd person" is substituted for the former words "or
third person", for clarity. The former words appeared
to be a technical error since a third person would not
make a contribution for the benefit of a worker.
Rather, a contractor or subcontractor would make a
contribution "to a 3rd person" for the benefit of a
worker.

17-209. ANNUAL DETERMINATION.
(A) IN GENERAL.
ON THE COMMISSIONER'S OWN INITIATIVE, THE COMMISSIONER MAY
SHALL DETERMINE THE PREVAILING WAGE RATE FOR A CLASSIFICATION OF
WORKER IN A LOCALITY BY CONSIDERING AMONG OTHER THINGS:
(1) WAGE RATES ESTABLISHED BY COLLECTIVE BARGAINING
AGREEMENTS; AND
(2) (l) ANY OTHER PAYROLL INFORMATION RELEVANT TO THE
DETERMINATION . ; AND
