both subtitles provide for debarment, the same procedural

provisions would apply. However, the procedural provisions

applicable to debarment under Subtitle 1 are contained in the

regulations of the Board. The General Assembly may wish to

consider adopting the same procedures for both subtitles to avoid
confusion and inconsistent treatment of persons subject to
debarment.

TITLE 17. SPECIAL PROVISIONS — STATE AND LOCAL
SUBDIVISIONS.

SUBTITLE 1. SECURITY FOR CONSTRUCTION CONTRACTS.

17-101. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language added as
the standard introductory language to a definition
section.

(B)  PAYMENT SECURITY.

"PAYMENT SECURITY" MEANS SECURITY TO GUARANTEE PAYMENT FOR
LABOR AND MATERIALS, INCLUDING LEASED EQUIPMENT, UNDER A CONTRACT
FOR CONSTRUCTION.

REVISOR'S NOTE: This subsection is new language added to
provide an express definition for "payment security".

Defined term: "Construction" § 11-101

(C)  PERFORMANCE SECURITY.

"PERFORMANCE SECURITY" MEANS SECURITY TO GUARANTEE THE
PERFORMANCE OF A CONTRACT FOR CONSTRUCTION.

REVISOR'S NOTE: This subsection is new language added to
provide an express definition for "performance
security".

Defined term: "Construction" § 11-101

(D)  PUBLIC BODY.
"PUBLIC BODY" MEANS:
