reference to an act or omission "which would subject
that person to disqualification under [former] §
12-102(b)(2)......"

In subsection (e)(1) of this section, the former
reference to "businesses" is deleted as included in
"persons".

16-204. RIGHT TO HEARING; NOTICE.

(A)  RIGHT TO HEARING.

BEFORE BEING DEBARRED, A PERSON SUBJECT TO DEBARMENT UNDER §
16-203(C) OF THIS SUBTITLE IS ENTITLED TO A HEARING BEFORE THE
BOARD.

(B)  NOTICE; REQUEST FOR HEARING.

WHENEVER WHEN A UNIT CONTRACTING FOR A PUBLIC BODY IS
NOTIFIED THAT A PERSON WHO HAS APPLIED FOR A CONTRACT IS SUBJECT
TO DEBARMENT UNDER THIS SUBTITLE, THE UNIT SHALL NOTIFY THE
PERSON IN WRITING THAT:

(1)  THE APPLICATION MAY BE DISQUALIFIED; AND

(2)  THE PERSON HAS A RIGHT TO A HEARING BEFORE THE
BOARD.

(C)  WAIVER.                                                               

UNLESS A PERSON SUBMITS A REQUEST TO THE BOARD FOR A HEARING
WITHIN 30 DAYS AFTER RECEIVING NOTICE UNDER THIS SECTION, THE
PERSON:

(1)  IS DEEMED TO HAVE WAIVED THE RIGHT TO A HEARING;
AND

(2)  IS DEBARRED.

REVISOR'S NOTE: Subsection (a) of this section is new
language added to state' expressly that a person
subject to debarment is entitled to a hearing.

Subsections (b) and (c) of this section are new
language derived without substantive change from
former SF § 12-103.
