16-106. LIMITATIONS PERIOD ON DEBARMENT.

DEBARMENT PROCEEDINGS UNDER THIS SUBTITLE MAY BE INSTITUTED
WITHIN 5 YEARS AFTER:

(1) THE OCCURRENCE OF THE EVENT THAT CONSTITUTES A
REASON FOR A DEBARMENT PROCEEDING;

(2) A FINAL JUDGMENT IN A CIVIL OR CRIMINAL ACTION
THAT CONSTITUTES A REASON FOR A DEBARMENT PROCEEDING; OR CAUSE
FOR DEBARMENT;

(3)(2) AN ADMISSION, IN WRITING OR UNDER OATH, OF AN
ACT OR OMISSION THAT CONSTITUTES GROUNDS FOR A CRIMINAL
CONVICTION OR CIVIL LIABILITY THAT MAY BE A REASON FOR A
DEBARMENT PROCEEDING CAUSE FOR DEBARMENT; OR

(3) THE OCCURRENCE OF ANY OTHER EVENT THAT
CONSTITUTES A CAUSE FOR DEBARMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § ll-211(b).

In item (2) of this section, the language "in writing
or under oath, of an act or omission that constitutes
grounds for a criminal conviction or. civil liability"
is added to clarify the type of "admission" that
constitutes cause for debarment proceedings under §
16-104(c) of this subtitle.

In item (3) of this section, the word "event" is

substituted for the former word "act", since an

omission also constitutes a reason for debarment
proceedings.

GENERAL REVISOR'S NOTE TO SUBTITLE:

Former SF § ll-211(a)(1), which defined "[b]usiness", is
deleted as unnecessary since the word "business" did not appear
in the former law.
