(4) ON REMAND, THE PROCUREMENT OFFICER SHALL PROCEED
UNDER SUBSECTION (B) OF THIS SECTION IN ACCORDANCE WITH THOSE
INSTRUCTIONS.
REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § 11-137(c)
and (d).
In the introductory language of subsection (b)(1) of
this section, the reference to "§ 15-217 of this
subtitle" is substituted for the former reference to
"subsection (b) of this section", to reflect the
reorganization of this revision. Although § 15-217 of
this subtitle revises only former SF § 11-137(b)(1),
former SF § ll-137(b)(2) and (3) are revised as
defined terms, which appear in § 15-215 of this
subtitle.
In subsection (b)(1)(iii) of this section, the
reference to discussions "with interested parties" is
added, for clarity.
In subsection (b)(1)(iv) of this section, the former
words "adopted by the appropriate department" are
deleted as unnecessary in light of the word
"applicable", which modifies the word "regulations".
In subsection (b)(2) of this section, the reference to
the "Office of the Attorney General" is substituted
for the former obsolete reference to the "State Law
Department".
The introductory language of subsection (c)(1) of this
section is revised to state affirmatively that the
"procurement officer" is responsible for performing
the acts described in subsection (c)(1)(i), (ii), and
(iii).
In subsection (e)(1) of this section, the word "shall"
is substituted for the former word "may", to clarify
that, except as provided under subsection (e)(3) of
this section, the reviewing authority is required to
take 1 of 3 actions concerning the decision of the
procurement officer: (1) approval; (2) disapproval; or
(3) modification.
In subsection (e)(4) of this section, the words "in
accordance with those instructions" are added to
clarify the manner in which the procurement officer
"shall proceed" on a remand from the reviewing
authority. The Procurement Revision Review Committee
calls the attention of the General Assembly to this
addition.
