PROCUREMENT FOR WHICH THE PROCEDURE FOR NONCOMPETITIVE NEGOTIATED
PROCUREMENT HAS BEEN APPROVED UNDER § 13-106 OF THIS ARTICLE.

(E) FORM OF REPORTS TO GENERAL ASSEMBLY.

A REPORT TO THE GENERAL ASSEMBLY UNDER THIS SECTION IS
SUBJECT TO § 2-1312 OF THE STATE GOVERNMENT ARTICLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § 11-131.

Subsection (a)(1) of this section is revised to state
affirmatively that the "procurement officer"
reasonably expects the procurement contract to be
performed outside the State and the District of
Columbia. This revision is consistent with the
revised language of § 13-103(c) of this article.

In subsection (a)(1) of this section, the reference to
former § "ll-lll(c)" is deleted as unnecessary, since
that former subsection merely provided a cross
reference to former § ll-110(b)(2), which is revised
as § 13-103(c) of this subtitle.

In subsection (a)(2) of this section, the word "or" is
substituted before the words "engineering services"
for the former word "and", because it did not seem to
be the intent of the General Assembly to require the
report only if the procurement was for all of the
items listed.

In subsection (b)(l)(iii) of this section, the
reference to "a description of the procurement" is
substituted for the former references to the type of
procurements associated with the procurement contracts
being reported, since subsection (a)(2) of this
section designates the procurements that must be
reported and subsection (a)(3) of this section applies
to any procurement under § 13-107 or § 13-108 of this
article. Although the former law required a report on
a procurement awarded under § 13-107 or § 13-108 of
this article to describe only "the supplies, services,
construction, or construction related services
procured or real property leased", it did not seem to
be the intent of the General Assembly to exclude
architectural services or engineering services from
the. report.
