LAWS OF MARYLAND

In subsection (a)(3) of this section, the term
"resident bidder" is substituted, as the defined term,
for the former term "Maryland firm", since the bidder
need not be a firm.

Former SF § ll-148(a)(3), which defined "nonresident
firm", is deleted as unnecessary since the term does
not appear in this revised section.

14-402. PAPER PROCUREMENT BY DEPARTMENT OF GENERAL SERVICES.

(A)   "RECYCLED PAPER" DEFINED.

IN THIS SECTION, "RECYCLED PAPER" MEANS A PAPER PRODUCT AT
LEAST 80% OF THE TOTAL WEIGHT OF WHICH CONSISTS OF THE PRODUCT OF
A MANUFACTURING PROCESS THAT:

(1)  HAS CONVERTED A RAW MATERIAL INTO A VALUABLE
COMMODITY; AND

(2)  INCLUDES A TOTAL GROSS CONTENT OF POST CONSUMER
WASTE OF AT LEAST 80%.

(B)  PURCHASES OF PAPER AND PAPER PRODUCTS.

TO THE EXTENT PRACTICABLE, IN PROCURING PAPER OR PAPER
PRODUCTS UNDER TITLE 4, SUBTITLE 3, PART II OF THIS ARTICLE, THE
SECRETARY OF GENERAL SERVICES SHALL BUY OR APPROVE FOR PURCHASE
ONLY SUPPLIES THAT ARE PRODUCED FROM RECYCLED PAPER.

(C)  REQUIRED VOLUME.

OF THE TOTAL VOLUME OF PAPER THAT THE SECRETARY OF GENERAL
SERVICES BUYS, AT LEAST 40% SHALL BE RECYCLED PAPER.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § 11-146.

Subsection (a) of this section is revised to include
the substance of the definition of "[s]econdary waste
materials", which appeared only once in the former
law. Therefore a separate definition was not
necessary.
