2.  MAKE A FALSE OR FRAUDULENT STATEMENT
OR REPRESENTATION; OR

3.  USE A FALSE WRITING OR DOCUMENT THAT
THE PERSON KNOWS TO CONTAIN A FALSE OR FRAUDULENT STATEMENT OR
ENTRY.

(2)  A PERSON WHO VIOLATES ANY PROVISION OF THIS
SUBSECTION IS GUILTY OF A FELONY AND ON CONVICTION IS SUBJECT TO
A FINE NOT EXCEEDING $20,000 OR IMPRISONMENT NOT EXCEEDING 5
YEARS OR BOTH.

(3)  A PERSON WHO IS CONVICTED UNDER THIS SUBSECTION
OR, DURING THE COURSE OF AN OFFICIAL INVESTIGATION OR OTHER
PROCEEDING, ADMITS IN WRITING OR UNDER OATH, ACTS OR OMISSIONS
THAT CONSTITUTE GROUNDS FOR CONVICTION IS SUBJECT TO THE
PROCEDURES FOR DEBARMENT FROM CONSIDERATION FOR THE AWARD OF
PROCUREMENT CONTRACTS IN ACCORDANCE WITH GENERAL DEBARMENT
REGULATIONS OF THE BOARD. ON A FINDING OF A VIOLATION UNDER THE
GENERAL DEBARMENT REGULATIONS, THE PERSON SHALL BE DEBARRED FOR
ANY PERIOD THAT THE BOARD DETERMINES TO BE APPROPRIATE UNDER THE
CIRCUMSTANCES.

(B) MISDEMEANOR OFFENSE.

(1)  A PERSON MAY NOT MAKE A FALSE STATEMENT ABOUT
WHETHER AN ENTITY HAS CERTIFICATION.

(2)  A PERSON WHO VIOLATES THIS SUBSECTION IS GUILTY
OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $2,500 OR IMPRISONMENT NOT EXCEEDING 1 YEAR OR BOTH.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § ll-148(e)
and (f).

In subsection (a)(l)(v)l. of this section, the former
word a "trick" is deleted as included in the words a
"scheme or device".

In subsection (a)(l)(v)2. of this section, the former
word "fictitious" is deleted as included in the words
"false" and "fraudulent".
