Ch. 48                                          LAWS OF MARYLAND

AN ANNOUNCEMENT OF A REQUEST UNDER THIS SECTION SHALL:

(1)  DESCRIBE GENERALLY THE ARCHITECTURAL OR
ENGINEERING SERVICES THAT ARE THE SUBJECT OF THE PROCUREMENT; AND

(2)  INDICATE HOW AN INTERESTED PERSON MAY RECEIVE
INFORMATION ABOUT THE PROCUREMENT.

(D) NEGOTIATION BY TRANSPORTATION UNIT.

A TRANSPORTATION UNIT SHALL NEGOTIATE COMPETITIVELY EACH
PROCUREMENT CONTRACT FOR ARCHITECTURAL OR ENGINEERING SERVICES
COSTING $100,000 OR LESS?

(1) ON A COMPETITIVE BASIS; AND

(2) AT A PRICE THAT THE TRANSPORTATION UNIT
DETERMINES TO BE FAIR AND REASONABLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF §§ 11-155
and 11-157.1.

In subsection (a)(1) of this section, the requirement
that a transportation unit "submit a request to the
Secretary of Transportation" is added to state
expressly that which only was implied in the former
law.

13-311. SELECTION AND NEGOTIATION OF CONTRACTS FOR
TRANSPORTATION UNITS.

(A)  SELECTION PROCESS OF DEPARTMENT.

THE DEPARTMENT OF TRANSPORTATION SHALL ESTABLISH A SELECTION
PROCESS BASED ON A COMPETITIVE PROCEDURE TO:

(1)  EVALUATE TECHNICAL PROPOSALS AND THE
QUALIFICATIONS OF THE PERSONS SUBMITTING PROPOSALS; AND

(2)  DETERMINE AN ORDER OF PRIORITY BASED ON THOSE
EVALUATIONS.

(B)  NEGOTIATION BY TRANSPORTATION UNITS.
