(H) (F) PUBLIC NOTICE OF AWARD.
A UNIT SHALL PUBLISH IN THE MARYLAND REGISTER NOTICE OF A
PROCUREMENT CONTRACT AWARDED UNDER THIS SECTION.
REVISOR'S NOTE: Subsections (a)(1) and (2)(ii) through (iv)
and (b) through (f) of this section are new language
derived without substantive change from former SF §
ll-110(b)(1), (2)(ii) through (vi), and (3) through
(6), (c)(1), (2), (3)(ii), and (4) through (7), and
(d) and the third sentence of § ll-140(d).
Subsection (a)(2)(i) of this section is new language
added for clarity.
Subsections (b)(1) and (4), (c)(l)(ii), (d)(1) and
(3), (e)(1), (2), and (3)(i) and (iii) of this section
are revised, in the active voice, to clarify that the
"procurement officer" is responsible for the actions
under these subsections, since these actions seem to
fall within the powers contemplated for a "procurement
officer", as defined in § ll-101(n) of this article.
On the other hand, subsections (b)(1)(ii)2.,
(c)(l)(i), and (f) of this section are revised to
refer to the amorphous "unit" since the duties under
these subsections do not fall clearly within the
responsibilities of any single individual. The
revision of subsections (c)(1)(i) and (f) of this
section is consistent with SG § 7-206(c), which refers
to a "unit" publishing a document and reimbursing the
Division of State Documents for the cost of
publication.
In subsection (b)(l)(ii) of this section, the
authority to "direct" is substituted for the former
words "at the procurement agency's option", for
clarity and brevity.
The introductory language of subsection (c)(4) of this
section, "[i]n addition to any notice required under
this subsection," is substituted for the former,
ambiguous word "also" to clarify that publishing
notice on a bid board or in a newspaper, periodical,
or trade journal is "in addition to" and not in
substitution for publishing notice in the Maryland
Register. In light of this substitution, in
subsection (c)(4)(i) of this section, the former
reference to bids "not required to be published in the
Maryland Register" is deleted.
In subsection (d)(3)(ii) of this section, the
reference to "the Office of the Attorney General" is
substituted for the former obsolete reference to "the
