The term "primary procurement units" is substituted,
as the defined term, for the former word "department"
for accuracy, because neither the State Treasurer nor
the University of Maryland is a "department" as
provided under SG § 8-201.
(L) PROCUREMENT.
(1) "PROCUREMENT" MEANS THE PROCESS OF:
(I) LEASING REAL OR PERSONAL PROPERTY AS
LESSEE; OR
(II) BUYING OR OTHERWISE OBTAINING SUPPLIES,
SERVICES, CONSTRUCTION, CONSTRUCTION RELATED SERVICES,
ARCHITECTURAL SERVICES, OR ENGINEERING SERVICES.
(2) "PROCUREMENT" INCLUDES THE SOLICITATION AND AWARD
OF PROCUREMENT CONTRACTS AND ALL PHASES OF PROCUREMENT CONTRACT
ADMINISTRATION.
REVISOR'S NOTE: This subsection is new language derived
without substantive change from former SF § ll-101(z).
In paragraph (l)(i) of this subsection, the reference
to leasing "personal" property is added to reflect
former SF § 11-101(k)(1), which defined a procurement
"[c]ontract" as an agreement for "the lease ... of ...
personal property", and former § ll-101(v), which
defined "[l]ease" as a "contract under which the State
uses ... personal property". In light of this
addition, and the broad reference to "obtaining", in
paragraph (l)(ii) of this subsection, the former
reference to "leasing ... supplies ... or engineering
services" is deleted.
In paragraph (2) of this subsection, the defined term
"procurement contract[s]" is substituted for the
former term "contract". See revisor's note to
subsection (m) of this section.
Also in paragraph (2) of this subsection, the former
reference to a "description of requirements" is
deleted as included in the reference to a
"solicitation".
Also in paragraph (2) of this subsection, the former
references to "selection of sources" and "preparation"
of the contract are deleted as included in the
reference to "award of procurement contracts".
