REVISOR'S NOTE: Ch. ___, Acts of 1988, which enacted

Division II of this article, amended this section to
substitute the words "unit that procures supplies
under Division II of this article" for the former term
'using agency". See revisor's note to § 4-304 of this

4-315.

(a) An employee of a [using agency] UNIT THAT PROCURES
SUPPLIES UNDER DIVISION II OF THIS ARTICLE whose salary and
expenses are paid from the fees of the employee's office may not
pay any contractor or seller for any article of any kind acquired
for the [using agency] UNIT unless the invoice approved by the
employee is also approved by the Secretary or a designee of the
Secretary.

4-412.

(a)  Except as otherwise provided in this section, the
Division exclusively shall negotiate the acquisition of land:

(1)  for any public improvement; and

(2)  for any State project funded under the State
share of Program Open Space.

(b)  The Division shall make each State acquisition in the
name of:

(1) the [using agency] UNIT OF THE STATE GOVERNMENT;

or

(2) the principal department of the State government
to which the [using agency] UNIT belongs.

(c)  The Division is not responsible for acquiring land for
a local project.

(d)  (1) The Division is not responsible for developing any
acquired land.

(2) Development of any land acquired under Program
Open Space is the responsibility of the (using agency] UNIT OF
THE STATE GOVERNMENT.
