Assurance may not be expended until the
Department of Health and Mental Hygiene
develops a plan for review by the budget
committees, the Senate Economic and
Environmental Affairs Committee and the
House Environmental Matters Committee
which details how these resources will
be allocated to substantially improve
the disciplinary system for the State's
physicians. This plan shall include,
but not be limited to:

a.  standards for improving investigation
in quality of care claims;

b.  a timetable for the disposition and
elimination of the current backlog of
cases;

c.  standards for the timely disposition of
all cases submitted to hearing officers
and brought before the new board;

d.  steps that will be taken, in

conjunction with the Department of
Personnel, including development of new
classifications, if appropriate, to
improve the salary structure for the

positions of assistant attorney

general, hearing officer and

investigator, that will be hired for the
new board;

e.  proposals for specialized training of
the personnel that will be allocated to
the board;

f.  steps that will be taken to ensure that
resources allocated to the new State
Board of Medical Quality Assurance will
not be diverted to other boards or
other purposes in the department;

g.  status of the State employees currently
assigned to the State Board of Medical
Examiners.

The report shall be submitted to the
committees not later than July 1, 1988.
Funds shall be released upon approval of
the budget committees. This appropriation
may only be expended for the purpose of
the State Board for Medical Quality
