7-105. HEARINGS.

(A)  REQUIRED.

AFTER REASONABLE NOTICE TO THE PARTIES TO THE AGREEMENT, THE
BOARD OF ARBITRATORS CHOSEN UNDER § 7-104 OF THIS SUBTITLE SHALL
HOLD HEARINGS AT THE TIMES AND PLACES THAT THE BOARD DETERMINES.

(B)  RIGHTS OF PARTIES.

AT THE HEARINGS, EACH PARTY TO THE AGREEMENT MAY:

(1)  PRESENT EVIDENCE; AND

(2)  EXAMINE WITNESSES.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 81, § 178.

In subsection (b)(1) of this section, the former right
"to be heard" is deleted as included in the reference
to the right to "present evidence".

In subsection (b)(2) of this section, the former right
to "cross-examine" is deleted as included in the right
to "examine" witnesses.

7-106. POWERS OF BOARD; FAILURE TO OBEY SUBPOENA.

THE BOARD OF ARBITRATORS MAY ADMINISTER OATHS, TAKE
TESTIMONY, AND SUBPOENA WITNESSES AND BOOKS, RECORDS, AND OTHER
DOCUMENTS. A SUBPOENA MAY BE SIGNED BY ANY MEMBER OF THE BOARD.
IF A PERSON FAILS TO OBEY A SUBPOENA, ON PETITION OF THE BOARD,
ANY COURT OF RECORD OF THIS STATE MAY PASS AN ORDER REQUIRING
COMPLIANCE WITH THE SUBPOENA AND MAY PUNISH FAILURE TO OBEY THE
ORDER AS A CONTEMPT.

REVISOR'S NOTE: This section formerly appeared as Art. 81,
§ 179.

The word "records" is substituted for the former word
"papers", for clarity.

The former reference to the power of the board to
"require the attendance of" witnesses and "the
production" of documents is deleted as included in the
meaning of "subpoena".

The former reference to issuing "commissions to take
testimony" is deleted as obsolete.
