(2) After deducting from the takeout the applicable
tax of this State on the entire pari-mutuel pool, the amount to
be paid under the terms of the contract to the out-of-state
racetrack, and the cost of transmission, the remainder shall be
allocated in the same proportions as normally applicable to
racing conducted by the licensee.
(d) The terms and conditions of any contract with an
out-of-state racetrack made under this section are subject to the
approval of the respective groups which represent a majority of
the horsemen racing at that track and a majority of the
applicable breeders in this State.
(e) The provisions of the Federal Interstate Horseracing
Act of 1978, Title 15, Sections 3001 through 3007, U.S. Code,
shall be instructive regarding the intent of this section.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of
the public health and safety, has been passed by a yea and nay
vote supported by three-fifths of all the members elected to each
of the two Houses of the General Assembly, and shall take effect
from the date it is enacted.

Budget Bill
(Fiscal Year 1989)
AN ACT for the purpose of making the proposed appropriations
contained in the State Budget for the fiscal year ending
June 30, 1989, in accordance with Article III, Section 52 of
the Maryland Constitution; and generally relating to
appropriations and budgetary provisions made pursuant to
that section.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That subject to the provisions hereinafter set forth
and subject to the Public General Laws of Maryland relating to
the Budget procedure, the several amounts hereinafter specified,
or so much thereof as shall be sufficient to accomplish the
purposes designated, are hereby appropriated and authorized to be
disbursed for the several purposes specified for the fiscal year
beginning July 1, 1988, and ending June 30, 1989, as hereinafter
indicated.
