(d) (2) If the failure to pay the tax is due to an attempt
to defraud, then the penalty shall be, in lieu of the penalty
more specifically provided for [by subsection (d) of this
section] UNDER PARAGRAPH (1) OF THIS SUBSECTION, 100 percent of
the tax due, plus interest at the rate of 1.5 percent per month
or fraction of a month from the time due until paid.

(b) Notwithstanding subsection (a) of this section, if a
person is convicted of any of the following boating safety
violations in the operation of a vessel, the person is required,
as a condition of probation or sentencing, to successfully
complete a boating safety education course that is offered or
approved by the Department:

(3) Operating under the influence of alcohol, any
drug, combination of drugs, or combination of drugs and [alcohol]
ALCOHOL, in violation of § 8-738 of this subtitle.

8-803.

(a) (2) (ii) Regulations adopted pursuant to this paragraph
may not apply:

1.  To floodproofing of any existing
[structure,] STRUCTURE; or

2.  If use of the Pennington Avenue
sanitary landfill site in Baltimore City as a sanitary landfill
is terminated by the end of May 1, 1981, to any construction,
reconstruction, development, or use of those properties in
Baltimore City comprising and known as the Woodberry Quarry
sanitary landfill site.
